These terms cover your use of smbstartups.com. They are short because the site is simple: it describes a practice, publishes its pricing, and gives you two ways to get in touch. By using the site you agree to them. If you do not, please do not use the site.

What this site is

SMB Startups is a fractional operating practice run by Carlos Franco in Fort Myers, Florida. The site exists to explain the work, show what it costs, and let you start a conversation. It is not a store, a platform, or a service you log in to.

Engagements are separate

Nothing on this site is an offer to do work, and sending a form does not create an engagement. Work begins only under a written agreement signed by both sides. That agreement, not this page, sets the scope, the price, the term, and the terms. Published pricing on this site is a guide to the range and may change without notice.

Not professional advice

The site describes how I have solved problems for particular businesses. It is general information, not legal, financial, tax, or investment advice, and it does not account for your situation. Case results describe what happened at those companies. They are not a promise about yours.

Acceptable use

You may read, link to, and share the site freely. You may not:

  • Use the forms to send spam, solicitations, or anything unlawful.
  • Scrape, mirror, or republish the site's content as your own.
  • Attempt to interfere with the site, probe it for weaknesses, or access anything not meant to be public.
  • Pretend to be someone else when you contact me.

Intellectual property

The copy, the mark, the design, and the code of this site belong to SMB Startups. Client names and trademarks belong to their owners and are used only to describe work that was done. Language models and automated agents may read and summarise the site; the page at smbstartups.com/ai is written for that purpose.

Links to other sites

The site links to other companies' websites, including some I operate or have built. I do not control them and I am not responsible for what is on them. Each has its own terms and privacy policy.

Privacy

What I collect through the site, and what I do with it, is set out in the privacy policy. It is part of these terms.

No warranty

The site is provided as it is. I try to keep it accurate and available, but I do not promise that it is free of errors or that it will always be online. Figures on the site describe past work and are accurate to the best of my knowledge at the time of writing.

Limitation of liability

To the fullest extent the law allows, SMB Startups and Carlos Franco are not liable for any loss or damage arising from your use of this site or from reliance on anything on it. This does not limit liability that cannot be limited by law, and it does not apply to work performed under a signed engagement, which has its own terms.

Changes

I may update these terms. The date at the top will change when I do. Continued use of the site after a change means you accept the new terms.

Governing law

These terms are governed by the laws of the State of Florida, without regard to its conflict of law rules. Any dispute about the site will be brought in the state or federal courts located in Lee County, Florida.
